
It is vitally important that the Exporters of goods from Kenya understand the Prohibited and Restricted Exports in order to stay compliant with the Customs Laws. The list of the Prohibited and Restricted Exports from Kenya are domiciled in the Third Schedule of the East African Community Customs Management Act (EACCMA)2004.
Prohibited Goods
According to the East African community Customs Management Act (EACCMA), 2004, “prohibited goods means any goods the importation, exportation, or carriage coastwise, of which is prohibited under this Act or any law for the time being in force in the Partner States (East African Community).”
Below re the details of goods that are Prohibited from Exportation from Kenya:
1.All goods the exportation of which is prohibited under this Act or by any written law for the time being in force in the Partner States.
2.Used or scrap cables and conductors of Aluminium, Steel and Copper.
Restricted Goods
On the other hand, “restricted goods are defined as any goods the importation, exportation, transfer or carriage coastwise must abide with any set conditions regulated by or under the Customs laws”. This means that clearance for importation, exportation or carriage coastwise of restricted goods shall only be granted against import permits, certificates or any other authority issued by a relevant agency.
The exportation of the below goods from Kenya is Restricted:
1. (a) all goods the exportation of which is regulated under this Act or of any law for the time being in force in the Partner States.
(b) waste and scrap of ferrous cast iron.
(c) timber from any wood grown in the Partner States.
(d) fresh unprocessed fish (Nile Perch and Tilapia).
(e) wood charcoal.
(f) used automobile batteries, lead scrap, crude and refined lead and all forms of scrap metals
2. The following goods shall not be exported in vessels of less than two hundred- and fifty-tons register—
(a) Warehoused goods.
(b) goods under duty drawback.
(c) transshipped goods.

Conclusion
Failure to comply to the above restrictions and Prohibitions can lead to unnecessary costs such Port Storage, Container Detention Charges, Container Demurrage Charges, Truck Detention Charges, Seizure and even Forfeiture of goods by the relevant Customs Administrations among others.
